Terms and Conditions of Use

1. Definitions

• User: anyone who accesses the Platform, with or without an account.
• Advertiser: a User who publishes a listing, whether a private individual, broker, real estate agency, car dealership or business partner.
• Listing: a publication of a property for sale, rent or another transaction, or of a car for sale, with its details, price and photos.
• Aggregated listing: a listing that comes from a third-party portal or website (the "Source") and that the Platform displays with attribution and a link to that Source.

2. Nature of the service

Lo Encuentro is a real estate search engine and listing aggregator. We act solely as a technology intermediary that helps interested people get in touch with Advertisers.

Lo Encuentro is not a real estate agency or broker, does not own the advertised properties or vehicles, does not take part in negotiations, is not a party to any sale, lease or other contract entered into between Users, and charges no commission on such transactions.

Listing information (price, area, location, availability, photos, etc.) is the responsibility of the Advertiser or the Source. Lo Encuentro does not guarantee its accuracy or currency, nor the existence or condition of the properties. Currency conversions and approximate locations are for reference only.

We recommend verifying the property and its documentation in person (title, registry and cadastral status, debts, the broker's identity and license) before making any payment or signing any document.

Listings on the Platform may concern properties and cars. Lo Encuentro facilitates listings and contact between the parties. Publishing or moderating a car listing does not constitute a vehicle inspection or certification of ownership, history, mileage, mechanical condition, safety, registration status or documentation. Lo Encuentro does not act as a guarantor of these matters. Before agreeing to a purchase or making a payment, the parties should check the vehicle, the seller's identity and authority, and the relevant documents. This does not limit the User's non-waivable rights or any responsibilities the Platform has under applicable law.

3. User account

An account is required to publish listings and use certain features. Users must be at least 18 years old and legally able to enter into contracts.

Users agree to provide true, complete and up-to-date information and are responsible for keeping their password confidential and for all activity under their account. They must notify us immediately of any unauthorized use.

Anyone creating a broker, agency or partner account represents that they are authorized to act on behalf of the stated organization and, where local law requires it, hold the corresponding license or registration.

4. Publishing listings

By publishing a listing, the Advertiser represents and warrants that:

• they own the property or have sufficient authorisation from the owner to offer it;
• the information published is true, complete and not misleading, including price and currency;
• they hold the rights to the photos and texts they publish, or are authorized to use them;
• the listing complies with applicable law, including consumer protection, real estate brokerage and non-discrimination rules of the country where the property is located.

The Advertiser grants Lo Encuentro a free, non-exclusive, worldwide license, valid for as long as the listing is published, to host, reproduce, adapt (for example, resize images or translate texts) and display the listing content on the Platform and in its promotion, including social media and search engines.

Lo Encuentro may review, moderate, edit for formatting reasons, pause or remove listings that breach these Terms or raise suspicion of fraud, without any right to compensation. Listings may go through an approval process before being published.

For car listings, the Advertiser is responsible for the information they publish, including make, model, version, year, mileage, condition, features, price, currency, availability and photographs. They must provide accurate, current information and be entitled to offer the vehicle.

The "direct owner" category is the Advertiser's own declaration that they offer a vehicle they own without an intermediary. It does not mean Lo Encuentro has verified ownership or the absence of an intermediary. Advertiser categories do not constitute seller certification.

Publishing a car listing does not request a VIN/chassis number or license plate number. Do not include them in text or photos, or publish vehicle documents or other people's personal data. Conceal visible plates and other identifiers before uploading images. Photos must depict the vehicle on offer and must not misrepresent its condition. These obligations do not expand the content license provided in these Terms.

5. Aggregated third-party listings

Some listings come from publicly accessible external Sources. They are shown with the Source identified, a summary of their description and a link to the original listing; their content belongs to the Source or the original advertiser.

If you own aggregated content and want it corrected or removed, write to the contact email below identifying the listing. We will handle the request within a reasonable time.

6. Contact between users

Messages sent through contact forms are forwarded to the Advertiser together with the details the User includes (name, email, phone). Lo Encuentro does not control or guarantee any replies, offers or agreements arising from that contact.

Never transfer money as a deposit, reservation or guarantee without having visited the property or seen the vehicle and verified the other party's identity. If you spot a suspicious listing, report it via the contact email.

7. Prohibited conduct

It is forbidden to:

• publish non-existent properties, abusive duplicates, misleading prices or listings intended to defraud;
• publish unlawful, offensive or discriminatory content, or content that infringes third-party rights;
• publish third parties' personal data without their consent;
• use the Platform to send spam or unsolicited commercial communications;
• extract data from the Platform in bulk or by automated means without written permission, or interfere with its operation or security;
• create fake accounts or impersonate another person or organization.

Breaches may lead to suspension or termination of the account and removal of listings, without prejudice to any applicable legal action.

8. Intellectual property

The Lo Encuentro brand, design, software and the Platform's own content belong to Lo Encuentro or its licensors and are protected by intellectual property law. Using them grants the User no rights over them, other than to use the Platform in accordance with these Terms.

9. Price of the service and plans

Searching for properties on the Platform is free. To publish, Advertisers may use the Free plan or the Plus plan, which are taken per Advertiser (organization or individual) and cover all of their listings.

• Free plan: up to 3 active listings (including paused listings and listings awaiting review) and up to 8 photographs per listing.
• Plus plan: no limit on the number of listings; up to 20 photographs per listing; view and contact statistics; priority in the default order of results and on the home page; main listing when several Advertisers publish the same property; Plus badge; and priority in the paid promotional campaigns that Lo Encuentro runs on third-party platforms such as Google and Meta.

The list price of the Plus plan is USD 4.90 (four US dollars and ninety cents) per month. As a launch offer, the Plus plan is currently provided free of charge for a limited time, with an end date not yet set; afterwards it will cost the amount stated above. During this period we do not request payment details or charge any amount.

Before any change to the plans, their benefits or their price, and before we start charging, we will notify Advertisers by email with reasonable notice; only then will we request payment details. No charge will be made without the Advertiser's express confirmation. Advertisers who do not confirm will move to the Free plan without their published listings being removed; new listings and photographs will be subject to that plan's limits.

Plus priority refers to ordering and visibility within the Platform and to how campaigns are distributed; it does not guarantee a minimum number of views or contacts, nor that any transaction will take place. Lo Encuentro may adjust its ordering criteria and campaign spend. Each listing keeps its own photographs and description.

10. Limitation of liability

The Platform is provided "as is". Lo Encuentro strives to keep it available and working properly but does not guarantee that it will be free from interruptions or errors.

To the fullest extent permitted by law, Lo Encuentro shall not be liable for: the content of listings published by Advertisers or Sources; transactions, payments or agreements between Users; damage arising from the use of third-party information; or loss of profit or indirect damages.

Nothing in these Terms limits the non-waivable rights granted to the User by the consumer protection law of their country of residence (see the Country Annexes).

11. Indemnity

The Advertiser shall hold Lo Encuentro harmless from claims by third parties, including authorities, arising from the content of their listings or from breach of these Terms or the law.

12. Closing the account

Users may request that their account be closed at any time by writing to the contact email. Lo Encuentro may suspend or terminate accounts that breach these Terms. After closure, we will keep only the data the law requires us to retain, as described in the Privacy Policy.

13. Privacy

Personal data processing is governed by our Privacy Policy, which forms part of these Terms.

14. Changes

We may amend these Terms to reflect legal or service changes. The current version and its date will always be published on this page. For material changes, we will notify registered Users reasonably in advance and, where appropriate, ask for renewed acceptance. Continued use of the Platform after the effective date means acceptance of the new version.

15. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil, where the operator is based. A User acting as a consumer may bring any claim before the courts of their own domicile.

If the User resides, or the property is located, in another country, the mandatory consumer protection rules of that country that cannot be excluded by contract also apply. The Country Annexes at the end set out those rules and prevail over these Terms to the extent they are more specific.

The Spanish, Portuguese and English versions are equally valid; in case of discrepancy, the interpretation most favorable to the User prevails.

Annex A — Users in Brazil

The Consumer Protection Code (Law 8,078/1990), the Brazilian Internet Civil Framework (Law 12,965/2014) and the General Data Protection Law (LGPD, Law 13,709/2018) apply. No clause of these Terms prevents the User from going to the Brazilian courts or restricts rights those laws declare non-waivable.

Annex B — Users and properties in Paraguay

Law No. 1334/98 on Consumer and User Protection and Law No. 4868/13 on Electronic Commerce apply. The User keeps the right to complain to the consumer protection authority and the courts of the Republic of Paraguay, and the habeas data guarantee of article 135 of the Paraguayan Constitution.

Brokerage and the listing of properties located in Paraguay must comply with applicable Paraguayan regulations, which is the Advertiser's responsibility.
